Recording of Work Accidents and Occupational Diseases

One of the innovations introduced by the Occupational Health and Safety Law No. 6331 is the introduction of an effective registration system in occupational accidents and occupational diseases in enterprises. Records of occupational accidents or occupational diseases that occur now are kept more effectively and these records are kept up-to-date.

According to the law, the responsibility of the enterprises in this respect is as follows (Article 14):

  • Businesses must keep records of all occupational accidents and diseases and prepare a report on the results after conducting the necessary research.
  • Businesses are required to investigate the incidents that may cause harm or harm to the employees and the working environment, which do not result in any death or injury in terms of the safety of the employees, but which may cause harm to the working environment, conduct researches and report on the results thereof. must edit.

In case of any occupational accident or occupational disease, the enterprises are obliged to inform the Social Security Institution within the following periods:

  • If an occupational accident has occurred, it must be reported within three working days of the date of the accident.
  • If an occupational disease has been detected by a healthcare provider or doctor in the workplace, within three working days after the date of learning

If health service providers detect occupational diseases in an enterprise, they must refer them to the health service organizations authorized by the Social Security Institution.

Health care institutions are obliged to inform the Social Security Institution of the accidents they are notified to and the health institutions authorized by the SSI within 10 days at the latest.

On the other hand, businesses must ensure that employees are healthy. Health Surveillance article of the above-mentioned law regulates this issue (article 15).

Businesses must identify the health and safety risks to which they are exposed and ensure that they are subject to health surveillance. It is the employers' responsibility to carry out health checks of employees in the following cases:

  • When employees are hired
  • When employees make a job change
  • When employees return to work after leaving work due to an occupational accident, occupational disease or a health problem,
  • During the period in which the activities continue, taking into consideration the quality of the employee and the work and at regular intervals determined by the Ministry of Labor and Social Security depending on the hazard class of the enterprise.

If the entity's activities are classified as dangerous and very dangerous, the employees to be recruited are required to obtain a medical report stating that they are suitable for the job.

The costs arising from the health surveillance activities to be carried out in the enterprises shall be borne by the enterprise. These costs cannot be demanded from the employees. In addition, the health information should not be disclosed to third parties in order to protect the private life of employees.

Lift What, Lift What are the Inspection Principles?

In cases where manpower is not sufficient, construction machinery is used. They can be used easily in severe conditions and when human speed and strength are not enough. One of these is the lifts. Generally, hydraulic lifts are used in a wide range from shipyards to automobile mechanics. Hydraulic systems are mainly based on the movement of two easily intertwined cylinders with hydraulic fluid. Thanks to a pump, the narrow hydraulic cylinders provide enough power to easily lift tons of load. Oil is used as liquid in these machines. The cylinders must not leak air or liquid in any way. The operating system of these cylinders is based on the non-compressibility of liquids and works more reliably than air or other gases.

Hydraulic systems work in conjunction with a section where the oil is stored and a system applying pressure thereto. Lifts are widely used in various sectors because they take up little space, operate quietly and provide very high performance with little power. With the development of technology, safer lifts are produced today. However, they should be used in accordance with the rules and they should be maintained regularly because they work under heavy load. Lifts are produced in different types depending on the purpose of use, working system and capacities. For example, suitably two-post lifts, four-post lifts, reception lifts, scissor lifts and heavy duty lifts.

In 2013, the Ministry of Labor and Social Security issued the Regulation on Health and Safety Conditions in the Use of Work Equipment. Pursuant to this regulation, lifts belong to the group of vehicles that are at risk in terms of employee health and property safety of enterprises. Annexes of the Regulation on Maintenance, Repairs and Periodic Inspections (Annex 3) have been adopted among stackers such as lifts, forklifts and pallet trucks. Unless otherwise stipulated in the relevant regulations, regular inspection and controls of the lifts are required at least once a year.

Lifts must be able to lift and suspend at least the 1,25 floor of the declared load in a safe manner, unless otherwise specified in the relevant standards.

In the annex of this regulation, it is explained that the following standards should be taken into consideration in the inspection of the lifts:

  • TS 10689 Stability stackers and pallet stackers
  • TS EN ISO 3691-5 Industrial vehicles - Safety requirements and verification - Part: 5 - Pedestrian-controlled vehicles
  • TS ISO 5057 Industrial vehicles - Inspection and repair of fork lift forks in use

  • TS ISO 22915-2 Industrial trucks - Verification of stability - Part 2: Mast-balanced trucks
  • FEM 4.004 Periodic inspection of industrial trucks (European Transport Federation standard)
